1. Introduction

This Biometric Data Consent Form provides notice and obtains written consent for the collection, storage, and use of biometric data in accordance with the Illinois Biometric Information Privacy Act (BIPA) and similar state privacy laws.
FacePass, operated by TechKluster LLC, uses facial recognition technology solely for school attendance verification and parent notifications.

By providing consent, you acknowledge and agree to the collection and processing of biometric identifiers or biometric information as described in this document.

2. Definition of Biometric Data Collected

For the purpose of attendance verification, FacePass collects and processes:

  • A photographic image of the student

  • A mathematical face embedding derived from the image to identify the student during check-in and check-out

FacePass does not store raw biometric templates. The face embedding is a numerical representation and cannot be used to reconstruct the original photograph.

3. Purpose of Collecting Biometric Data

FacePass processes biometric data for the following purposes:

  • Verifying a student’s identity during check-in and check-out

  • Recording attendance for the school

  • Displaying check-in and check-out photos to parents

  • Ensuring accurate, secure, and efficient attendance tracking

Biometric data is not used for marketing, profiling, analysis unrelated to attendance, or any other secondary purpose.

4. Data Storage and Security

Biometric data is:

  • Stored securely on Google Cloud (Firebase, Cloud Run, Cloud Storage, Firestore)

  • Encrypted in transit and at rest

  • Accessible only to authorized school administrators, verified parents, and FacePass technical staff as necessary for system operation

No biometric data is shared or sold to any third-party organization.

5. Biometric Data Retention Schedule

FacePass retains biometric data based on the following schedule:

  • Face embeddings are retained for as long as the student is enrolled in the school using FacePass

  • Biometric data will be permanently deleted within 30 days of unenrollment or upon written request from a parent or guardian

  • Attendance photos are retained for 90 days, unless the school defines a different retention policy

Biometric data will not be kept for longer than is reasonably necessary to fulfill the purpose of attendance tracking.

6. Right to Revoke Consent

You may revoke consent at any time by submitting a written request to:

privacy@getfacepass.app

You may also request deletion through the school administration or through the FacePass parent application (if available).
Upon revocation, all biometric data will be permanently deleted within 30 days.

7. Prohibition on Sale or Disclosure

FacePass strictly complies with BIPA provisions and will:

  • Not sell, lease, trade, or profit from biometric data

  • Not disclose biometric data to any third party except:

    • When required by law

    • When required to provide services to the school (e.g., cloud hosting providers)

Biometric data is never used for advertising, resale, or commercial gain.

8. Written Biometric Consent (Required by BIPA)

By signing below, you acknowledge and agree that:

  • You have received written notice of the biometric data that FacePass collects

  • You understand the purpose and length of time for which the data will be stored

  • You consent to the collection, storage, and use of biometric data as described

  • You understand that you may request deletion or revoke consent at any time
