1. Introduction
Welcome to FacePass, a smart attendance and safety system developed and operated by TechKluster LLC (“FacePass,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your use of the FacePass mobile app, website, and related services (collectively, the “Service”).
By creating an account or using the Service, you agree to these Terms.
If you do not agree, please do not use FacePass.
2. Eligibility and Age Restrictions
FacePass is designed for use by:
Schools and educational institutions managing attendance.
Parents and guardians authorized by schools to receive attendance updates.
Users under the age of 18 may only use FacePass under supervision of a parent, guardian, or authorized school administrator.
We comply with COPPA and other child privacy laws.
3. User Responsibilities
By using FacePass, you agree to:
Provide accurate and up-to-date registration information.
Use the app only for legitimate educational and attendance-related purposes.
Keep login credentials confidential and secure.
Notify us immediately of unauthorized access or suspected misuse.
You are responsible for all activities that occur under your account.
4. Service Description
FacePass provides:
AI-powered check-in and check-out attendance verification through facial recognition.
Real-time notifications and photo confirmations for parents.
Attendance dashboards for school administrators.
We continuously improve our AI and app features, and may update the Service at any time.
5. Service Limitations
While FacePass uses advanced AI, we cannot guarantee:
100% accuracy in facial recognition under all lighting or environmental conditions.
Continuous uptime, as maintenance and cloud outages may occur.
Immediate notifications if internet connectivity issues arise.
We will make reasonable efforts to ensure service reliability and accuracy.
6. Account Suspension or Termination
We reserve the right to suspend or terminate accounts that:
Violate these Terms or applicable laws.
Misuse the Service or upload inappropriate content.
Attempt to bypass security or misuse facial data.
Upon termination:
Your access to the Service ends immediately.
Associated data may be deleted according to our Privacy Policy.
7. Intellectual Property
All content, trademarks, and technologies within FacePass — including but not limited to software code, logos, and AI models — are the intellectual property of TechKluster LLC.
You are granted a limited, non-exclusive, revocable license to use the Service for educational attendance management only.
You may not:
Copy, modify, or distribute FacePass content.
Reverse-engineer or attempt to extract AI models.
Use FacePass trademarks without written permission.
8. Prohibited Uses
You agree not to:
Use FacePass for any unlawful purpose.
Upload or store any data not related to authorized students or parents.
Attempt unauthorized access or interfere with the Service’s functionality.
Collect or scrape data from FacePass systems.
9. Limitation of Liability
To the maximum extent permitted by law:
FacePass and TechKluster LLC are not liable for indirect, incidental, or consequential damages.
We are not responsible for data loss, system failures, or inaccurate results caused by third-party issues (e.g., network, device, or hardware malfunctions).
Our total liability will not exceed the amount you paid (if any) to use the Service within the previous 12 months.
10. Disclaimer of Warranties
FacePass is provided “as is” and “as available.”
We make no express or implied warranties regarding:
Accuracy, reliability, or availability of the Service;
Suitability for a particular purpose; or
Non-infringement of third-party rights.
11. Dispute Resolution
Any disputes arising from these Terms shall first be attempted through informal negotiation by contacting legal@getfacepass.app.
If unresolved, disputes shall be settled by binding arbitration under the laws of Wyoming, USA, unless prohibited by local law.
12. Governing Law
These Terms are governed by and construed under the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.
For EU or UK users, local consumer protection laws still apply.
13. Changes to These Terms
We may modify these Terms to reflect new features, legal requirements, or operational changes.
When we do, we’ll:
Update the “Last Updated” date, and
Notify users in-app and via email (if significant).
Continued use of FacePass after changes indicates acceptance.
